Terms and Conditions

  1. Classic Web Solutions is referred thereafter as “the company” or as “Company”, and the customer as “The client” or “client”.
  2. Classic Web Solutions will fulfil the following services for the client, regardless of the option chosen
    • Optimise and set up web sites for a maximum search engine placement. Make necessary recommendation to client or to client’s Webmaster concerning eventual changes of the site in order to achieve maximum placement.
    • Submission Bronze Level is monthly. Silver Level is 48 hour refreshing database.
    • Determining the Google algorithm is no easy task. The best approach is to ensure that we keep within the guidelines laid out by major search engines such as Google. More than ever, the development of strong linking with other web sites is essential in achieving top positions.
    • Google make regular updates to algorithm, ranking may be affected by the Google update. When this happens Classic Web Solutions will advice and the necessary optimisation techniques will need to be applied.
    • Google can take 1 year to index your website.
  3. Most of our search engine techniques are done manually. However we are now using two leading software programs to assist in the process.
  4. Length of contractual agreement: every single agreement is based on a two-year contract involving monthly submissions in all cases. The client may cancel this yearly contractual agreement at any time with no penalty by simply giving the company a 30 days notice.
  5. Payment: work preparation is payable in advance along with at minimum the first quarter of year submission costs upfront regardless of the amount of sites to be submitted. Monthly submissions will be paid either upfront or quarterly.
  6. All orders are non-refundable. By accepting the company’s services, the client gives up any right for a refund.
  7. The company will not guarantee the acceptance of any listing by any search engines or directories. The company will not guarantee either placement of any listing on any search engines or any directories. Such elements are defined by search engines and directories at their discretion only. Therefore it is impossible to guarantee such aspect of the results from our side of the Internet. No claims will be able to be made regarding acceptance of the listing and/or its placement on any given search engines and/or directories.
  8. Most companies will require more than one optimisation before appearing on the first page of the Search Engine. This strictly depends on the submissions of the client competitor’s website on the search Engines.
  9. It is the client’s responsibility to provide the company with all appropriate keywords in English. The company will assist fully the client in electing the most adequate keywords/keyword combinations for a maximum optimisation.
  10. Only when applicable: Although the company will fully assist the client in transferring potential web sites to the company’s servers, it is however the clients’ responsibility to instruct their current service provider to comply with transfer instructions. Any delays resulting from potential transfer will not be the company’s responsibility in any regard.
  11. Should any of client’s URLs (whether referring to main web site or mirror sites) be hosted by a third party, it will be the client’s responsibility to provide the company with upload access information for optimisation purpose. If client decides to handle upload matters, the company would then e-mail the information to be uploaded directly to the client (In this case, the company would not be responsible for any upload mistakes.)
  12. The client will be responsible to provide the company with all his/her competitors’ information. Although this is not mandatory, it is recommended that company/client inform of all web sites to his/her knowledge constituting competition to the client. It is extremely helpful for the company in order to determine maximum keyword optimisation.
  13. By ordering the company’s services, the client accepts all the terms and conditions herewith mentioned. Each search engine have there own terms and conditions available on their website for review www.google.com, www.yahoo.com
  1. The client agrees that they shall not hold Classic Web Solutions liable for any losses (including loss of projected profits), costs or claims caused by website mistakes or omissions, or by failure of certain material to appear on the internet on a given date. This includes loss of data resulting from delays and/or service interruptions and the malfunction of equipment including any agents, freelance programs or associated companies or third party delays including domain names, FTP and web hosting or photographs/graphics. A project will be deemed to be complete even if the above are applicable.
  2. The client will be responsible for the content of their web pages, including obtaining the legal permission for any projects they include and ensuring that the content of these pages do not violate Australian and International Law. The client is also responsible for all texts, images and logos contained in their site.
  3. CWS reserves the right to remove material deemed inappropriate from your website without prior notice.
  4. A 30% deposit is required prior to job’s commencement.
  5. Classic Web Solutions requires all relevant information regarding the project (proposed website) within a period of 5 working days from the day the written agreement (terms and conditions) is signed, however any delay caused by the client in providing the necessary information will incur total charge at the client’s expense within a period of two weeks.
  6. The balance of a project is due on completion and should be paid in full within 14 days.
  7. Late payment of invoices may incur interest and/or late payment charges. Any Invoices paid after 14 days may be subject to a 10% P/A late payment fee. Should it be necessary to on-forward the outstanding account(s) to a debt collection agency, a 20 % surcharge of the balance may incur.
  8. On completion of the website, it is the customer’s responsibility to check the contents of the site and report any inaccuracies immediately.
  9. Classic Web Solutions will ensure the online security of the site, but on completion it is the client’s responsibility to ensure the ongoing security of the site including software updates and security patches.
  10. Classic Web Solutions will provide up to 3 hours of training and support per year to client with a Content Management System (CMS) website. If additional training or support is required after the initial three hours provided by CWS, a fee of $25 per hour will apply.
  11. Classic Web Solutions will hand out the Intellectual Property Rights to the customer after all invoices have been paid in full. The Intellectual Property Rights covers the design of the site, graphics, images, texts, etc.
  12. The Intellectual Property Rights of our $99 & $110 Monthly web design & SEO Packages belongs to Classic Web Solutions and Business Local Search.
  13. Classic Web Solutions takes no responsibility for the actions of any third parties used in the development or hosting of the Website.
  14. Any recommendation or agreement made through or by Classic Web Solutions on your behalf relating to third parties, such as web hosting or domain name hosting, falls on the terms and conditions laid out by the third party and Classic Web Solutions cannot be held responsible or liable for any downtime or loss.
  15. Classic Web Solutions retains the Intellectual Property Rights for the following software systems:
    • Content Management System
    • Hotel Reservation System
    • Databases System
    • Website Application
    • Shopping Cart
  16. Classic Web Solutions does not recommend the use of bulletin boards, message boards or chat rooms by clients. These are open possible abuse. However, if the customer requires CWS to install any of these facilities, the customer is liable for any posting or information added to these programs. CWS cannot be held liable for any information posted or displayed on these programs.
  17. Classic Web Solutions uses specific methods for developing websites and programs. During the construction of your site including software, databases and applications, we will continuously ask you to confirm that you are happy that specific elements of the project are complete to your satisfaction. If CWS are asked at a later date to carry out changes, these will be subject to an additional charge.

General Terms

  • Classic Web Solutions do not allow Adult, Warez, illegal MP3 Sites or IRC Bots.
  • The client may not store more data in their account than the allocated server space.
  • Your server (inc FTP) is for your personal use only. You must not reveal the password to any other parties and should take reasonable precautions to ensure that it is not discovered by other people.
  • Data stored on our servers is not guaranteed to be backed up. It is recommended that you keep an independent backup of all data on your virtual server.
  • You are responsible for maintaining insurance cover in respect of any loss or damage to data stored on the Server.
  • CWS shall not be held liable for any loss or damages caused by the use or misuse, unavailability or removal of services.
  • Whilst CWS shall use reasonable endeavours to ensure the integrity and security of the Server, we do not guarantee that the Server will be free from unauthorised users or hackers.
  • CWS does not warrant whatsoever that our virus security services to and from the Server will stop every virus from reaching your computer network. We make no warranty that the service will be error free or free from interruption of failure, and the company expressly disclaims any express or implied warranty regarding system and/or service availability, accessibility, or performance.
  • When your account is closed, all files (including web pages, domain emails, etc.) will be deleted.
  • CWS reserves the right to cancel your account at any time without notice.
  • CWS will not train the client or help you with the set up of your email accounts.
  • CWS will not change your MX records if your domain name is not hosted by us. You will need to contact your domain name hosting provider for the MX record changes.
  • Email attachment sizes are limited to 10 Megabytes.
  • Mailbox size is limited to 10 Megabytes (unless prior arrangements made in writing).
  • The client may not send, distribute, publish, allow to be sent, assist in the sending of spam or unsolicited commercial electronic messages, including, without limitation, commercial advertising, informational announcements, and mail bombing.
  • CWS shall not be held liable for any viruses obtained from any incoming emails.
  • CWS reserves the right to change web hosting companies and web servers without notice.
  • CWS reserves the right to update these Terms and Conditions at any time without notice.

Refunds

If you take out CWS yearly packages, we expect you to commit for this period of time. If you cancel your account within your service period then Classic Web Solutions will not make any refunds on any unused portions of your account.

Privacy

  • For quality control purposes your telephone conversations with Classic Web Solutions staff may be recorded from time to time.
  • The information you provide to us will be stored on our computer system. We are committed to protecting your privacy. We and any of our associated companies may use the information you provide us with to provide a more personalised service and to tell you about changes in our and their service or any new services which we think might be valuable to you.

Third Parties

  • Classic Web Solutions takes no responsibility for the actions of any third parties used in the hosting of the Website.
  • Any recommendation or agreement made through or by Classic Web Solutions on your behalf relating to third parties, such as web hosting or domain name hosting, falls on the terms and conditions laid out by the third party and Classic Web Solutions cannot be held responsible or liable for any downtime or loss.

Termination

The contract may be terminated:

  • Immediately by Classic Web Solutions if the client fails to pay any sums due hereunder within 14 days of due date.
  • Upon termination or expiry of the contract all amounts payable by the client to Classic Web Solutions shall become immediately due and we shall be entitled to immediately cease the provision of the services.
